Although child support payments are established in the original divorce decree, people's situations change, and if the original decree does not allow for adjustments it may lead to years of expensive litigation. In many divorce cases in Texas, child support payments are simply calculated by using the statutory guidelines and the paycheck of the paying parent. However, if the paying parent is self-employed or has other sources of income, it may be difficult to identify the income, often the source of a dispute. Income may be reduced by taxes, union dues, and health insurance premiums paid for the child. If the paying parent makes more than $6000 a month, or the child has special needs, the court may order additional child support payments. Child support must be paid until the child is eighteen (and has finished high school, if currently enrolled when turning eighteen). The parents may have a clause in their divorce agreement that requires support to continue through college. Even if the paying parent is being denied visitation the payments must continue. The visitation dispute is a separate issue under Texas family law. Child support payments are generally made through the court, and in that case any other payments made are considered gifts. Failure to pay child support can include penalties including jail and enforcement generally includes wage garnishment.
